Privacy Policy

RankBusiness (“us”, “we”, or “our”) operates the Foodie AI mobile application (the “Service”). This Privacy Policy explains what information we collect, why we collect it, how long we keep it, how you can have it deleted, and the rights you have over it.

This policy is written to meet the requirements of the Google Play User Data policy, the Apple App Store Review Guidelines and Apple’s App Privacy requirements, the UK GDPR and Data Protection Act 2018, and the EU GDPR. By using the Service you agree to the collection and use of information in accordance with this policy. Terms not defined here have the meaning given in our Terms and Conditions.

1. Information We Collect

While using our Service we may ask you to provide certain personally identifiable information that can be used to contact or identify you (“Personal Information”). This may include:

  • Identity data: name and email address, and (if you sign in with Apple or Google) the account identifier returned by that provider.
  • Nutritional data: calorie intake, macro-nutrient logs (carbohydrates, proteins, fats), meal entries and dietary preferences.
  • Visual data: photos of food that you upload or capture for AI analysis and calorie estimation.
  • Health profile data: weight, height, age, sex and activity level, used to calculate your personalised calorie budget. We treat this as special category / sensitive health data and handle it accordingly.
  • Purchase data: subscription status and transaction identifiers supplied by the Apple App Store or Google Play. We never receive or store your full card details.
  • Log and device data: information your device sends when you use the Service, such as IP address, device type, operating system version, app version, screens visited, crash reports, and the time and date of use.

Device permissions

The app may request access to your camera, your photo library and push notifications. Each permission is used only for the purpose described when it is requested — the camera and photo library are used solely so you can capture or select meal photos for analysis. You can change or revoke any permission at any time in your device settings (iOS: Settings → Foodie AI; Android: Settings → Apps → Foodie AI → Permissions). Revoking a permission may disable the related feature but does not otherwise affect your account.

2. How and Why We Use Your Information

We use the information we collect to:

  • Provide, operate and maintain the Service and your account.
  • Analyse the food photos you submit and estimate their nutritional content.
  • Calculate personalised calorie and macro-nutrient targets.
  • Show you your history, trends and progress over time.
  • Provide customer support and respond to your enquiries.
  • Diagnose faults, prevent abuse and fraud, and keep the Service secure.
  • Comply with our legal and regulatory obligations.

We do not sell your Personal Information, and we do not share it with data brokers or use it for third-party advertising.

Legal bases for processing (UK and EU users)

  • Performance of a contract — to deliver the Service you have signed up for.
  • Explicit consent — for health profile data and food photographs, which you may withdraw at any time by deleting the data or your account.
  • Legitimate interests — to secure, debug and improve the Service, provided your rights do not override those interests.
  • Legal obligation — where we must retain or disclose records by law.

3. AI and Image Processing

The Service uses artificial intelligence and computer vision to identify food items and estimate nutritional content.

  • Photo processing: when you upload a photo of a meal, it is transmitted securely to our AI engines, which identify ingredients and estimate portions and nutrition. Results are estimates and are not medical or dietary advice.
  • Model improvement: we may use de-identified, anonymised food images to improve the accuracy of our recognition models. Before any image is used for this purpose it is stripped of account identifiers and of EXIF metadata such as GPS location, so it can no longer be linked back to you. If you would prefer your images never to be used in this way, email us at Founder@foodiecal.pro and we will exclude your account.
  • No automated decisions with legal effect: our AI produces nutritional estimates only. It does not make decisions that produce legal or similarly significant effects concerning you.

4. Sharing and Service Providers

We share Personal Information only in the following circumstances:

  • Service providers: we use third-party companies to host our infrastructure, process images and provide AI inference. These providers may access your Personal Information only to perform tasks on our behalf, are bound by written contracts, and are prohibited from disclosing it or using it for any other purpose.
  • Legal requirements: where required by law, court order or subpoena, or where we reasonably believe disclosure is necessary to comply with the law or a lawful request from law enforcement.
  • Business transfer: if RankBusiness is involved in a merger, acquisition or sale of assets, your data may be transferred. We will notify you before your Personal Information becomes subject to a different privacy policy.

We do not sell, rent or trade your Personal Information, and we do not disclose your health or nutritional data for advertising, marketing or data-brokerage purposes.

International transfers

We are based in the United Kingdom, and our service providers may process data outside the UK or the European Economic Area. Where that happens, we rely on appropriate safeguards such as UK adequacy regulations, the UK International Data Transfer Addendum, or the EU Standard Contractual Clauses.

5. Tracking, Cookies and Advertising

Foodie AI does not display third-party advertising and does not track you across other companies’ apps or websites for advertising or measurement purposes. We do not use advertising identifiers (IDFA / Android Advertising ID) and we do not use third-party analytics or advertising SDKs.

Our website and any web pages served inside the app may use strictly necessary cookies and similar technologies to keep you signed in and to remember your preferences. You can instruct your browser to refuse cookies, though some parts of the Service may then not work.

If we ever introduce tracking as defined by Apple’s App Tracking Transparency framework, we will request your permission through the system prompt before any tracking begins, and we will update this policy and our App Store privacy disclosures first.

6. Data Retention

We keep Personal Information only for as long as it is needed for the purposes described in this policy, or for as long as the law requires. We do not keep your data indefinitely. Our current retention periods are:

Food photographs

Retained while your account is active so they remain visible in your diary; photos not saved to your diary are deleted from our servers within 30 days of processing. All photos are permanently deleted within 30 days of account deletion.

Anonymised images used for model improvement

Retained on an anonymised basis with all identifiers and metadata removed. Because this data can no longer be linked to you, it is not personal data and is not returned or deleted on request.

Log, diagnostic and crash data

Up to 12 months, after which it is deleted or aggregated into non-identifying statistics.

Purchase and subscription records

Up to 7 years, where required by UK tax and accounting law.

Support correspondence

Up to 24 months from the date the enquiry is closed.

Encrypted backups

Deleted data may persist in secure backups for up to 90 days before those backups expire and are overwritten.

 

If you stop using the Service without deleting your account, we will delete or anonymise your Personal Information after 24 months of continuous inactivity. We will email you before we do so.

7. How to Delete Your Data

You can delete your account and the personal data associated with it at any time. There are two ways to do this:

Option 1 — Delete in the app (immediate)

  1. Open Foodie AI and go to Profile → Settings → Account.
  2. Tap Delete Account.
  3. Confirm when prompted. Your account is deactivated immediately and your Personal Information is permanently erased from our active systems within 30 days, and from encrypted backups within a further 90 days.

Option 2 — Request deletion by email

Email Founder@foodiecal.pro from the address registered to your account, with the subject line “Data Deletion Request”. We will verify your identity and confirm deletion within 30 days. You do not need to have the app installed to make this request, and there is no charge.

What is deleted

  • Your name, email address and account credentials.
  • Your full nutritional and meal history.
  • Your health profile, including weight, height and activity data.
  • All food photographs you have uploaded.

What may be retained after deletion

  • Anonymised data that can no longer identify you, including anonymised images previously used for model improvement.
  • Purchase and tax records we are legally required to keep, retained for up to 7 years and used for no other purpose.
  • Records needed to establish, exercise or defend legal claims, or to prevent fraud and abuse.

Deleting individual items instead of your whole account

If you want to remove specific data rather than your entire account, you can delete individual meal entries and photos from within the app at any time, or email Founder@foodiecal.pro and tell us what you would like removed.

Cancelling a subscription

Deleting your account does not automatically cancel an active subscription. Subscriptions are managed by Apple or Google and must be cancelled in your App Store or Google Play account settings.

8. Your Privacy Rights

Depending on where you live, you have some or all of the following rights over your Personal Information:

  • Access — obtain a copy of the personal data we hold about you.
  • Rectification — have inaccurate or incomplete data corrected.
  • Erasure — have your personal data deleted, as described in Section 7.
  • Restriction — ask us to limit how we process your data.
  • Portability — receive your data in a structured, machine-readable format.
  • Objection — object to processing carried out on the basis of our legitimate interests.
  • Withdraw consent — withdraw consent at any time, without affecting processing carried out before withdrawal.

To exercise any of these rights, email Founder@foodiecal.pro. We will respond within 30 days. We will not discriminate against you for exercising your rights.

California residents: we do not sell or share personal information as those terms are defined by the CCPA/CPRA, and we do not use or disclose sensitive personal information for purposes other than providing the Service.

If you are in the UK and you are unhappy with how we have handled your data, you may complain to the Information Commissioner’s Office at ico.org.uk. EU users may complain to their local supervisory authority.

9. Security

The security of your Personal Information is important to us. We protect your nutritional logs, health profile and photographs using industry-standard encryption in transit (TLS) and at rest, access controls that limit staff access to the minimum necessary, and regular review of our providers’ security practices. However, no method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.

If a personal data breach occurs that is likely to result in a risk to your rights and freedoms, we will notify the Information Commissioner’s Office within 72 hours and inform affected users without undue delay.

10. Children’s Privacy

The Service is not directed to anyone under the age of 13, and we do not knowingly collect Personal Information from children under 13. In the EU and UK, where local law sets a higher age of digital consent (up to 16), that higher age applies. If we discover that a child below the applicable age has provided us with Personal Information, we will delete it from our servers promptly. If you believe a child has provided us with personal data, contact Founder@foodiecal.pro.

11. Apple and Google Platform Disclosures

This section summarises how we meet specific platform requirements:

  • Account deletion (Apple Guideline 5.1.1(v)): Foodie AI provides an in-app account deletion option that initiates deletion of your account and associated data, as described in Section 7.
  • App Privacy labels: the data types described in Section 1 correspond to the disclosures we make in the App Store “App Privacy” section and the Google Play Data Safety section. We keep both aligned with this policy.
  • Health and fitness data: health and nutritional data is used only to provide the Service to you. It is never used for advertising or marketing, never sold, and never shared with data brokers or with third parties for their own purposes.
  • Apple Health / HealthKit: Foodie AI does not currently read from or write to Apple HealthKit. If we add this in future, HealthKit data will be used solely to provide health and fitness features, will not be used for advertising or data mining, and will not be shared with third parties without your explicit consent.
  • Sign in with Apple: if you use Sign in with Apple and choose to hide your email, we receive only the private relay address and use it solely to communicate with you about the Service.
  • Data minimisation and location: we do not collect precise location data. Location metadata contained in photographs is stripped on upload.

12. Compliance With Laws

We will disclose your Personal Information where required to do so by law or subpoena, or where we believe in good faith that such action is necessary to comply with the law, to respond to a reasonable request from law enforcement, or to protect the rights, property or safety of RankBusiness, our users or the public.

13. Changes To This Privacy Policy

We may update this Privacy Policy from time to time. We will post the revised policy on this page and update the “Last updated” date at the top. Where changes are material, we will notify you in the app or by email before they take effect. You are advised to review this policy periodically.
